Welcome to ExamOS ("Service", "we", "our", "us"). By accessing or using the Service, you agree to these Terms of Use. If you do not agree, please do not use the Service.

1. Use of Service

The Service provides practice exams, study tools, and educational content for personal, non-commercial use only.

You agree to:

  • Provide accurate information
  • Use the Service only for lawful purposes
  • Comply with these Terms
  • Not misuse, disrupt, or attempt unauthorized access to the Service

We reserve the right to suspend, restrict, or terminate access at any time in accordance with these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must promptly notify us of any suspected unauthorized access or security issue involving your account.

We are not liable for losses resulting from your failure to safeguard your account credentials.

3. Account Use and Access Restrictions

Accounts are intended for individual, personal use only.

You agree that:

  • Your account is non-transferable
  • You will not share your account credentials with others
  • You will not allow multiple users to access a single account
  • You will not distribute, sublicense, or resell access to the Service

Use of individual accounts by businesses, organizations, institutions, teams, training centers, or groups is not permitted.

If you require corporate, institutional, classroom, team, or group access, you must contact us for appropriate licensing or permission.

We reserve the right to monitor reasonable usage indicators and to suspend, restrict, or terminate accounts that show signs of unauthorized or shared access.

Such action may be taken without refund where permitted by applicable law.

4. Content Disclaimer

All content is provided for practice, revision, and educational purposes only.

We do not guarantee:

  • Accuracy, completeness, or currency of content
  • That content reflects actual exam questions
  • Success in any certification exam
  • That use of the Service will meet your specific expectations or goals

You are responsible for your own preparation and exam decisions.

5. No Affiliation

We are not affiliated with, endorsed by, or sponsored by any certification providers, including but not limited to AWS, Microsoft Azure, Google Cloud, Cisco, CompTIA, or similar organizations.

All trademarks, service marks, logos, and brand names are the property of their respective owners and are used for identification purposes only.

6. Intellectual Property

Except for third-party marks and content lawfully referenced, all platform content, design, software, databases, text, graphics, and materials are owned by or licensed to us and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, republish, modify, create derivative works from, scrape, or exploit any portion of the Service except as expressly permitted by law or with our prior written permission.

7. Payments, Subscriptions, and Refunds

If the Service offers paid plans or features:

  • Prices and features may be updated at any time
  • Payments may be processed by third-party providers
  • We do not store full payment card details unless expressly stated
  • Unless otherwise required by applicable law or expressly stated, purchases are non-refundable
  • Subscription plans may renew automatically if clearly disclosed at purchase

You are responsible for managing your subscription, including cancellation before renewal where applicable.

We do not guarantee satisfaction, results, or exam outcomes.

8. Acceptable Use Policy

You agree not to:

  • Copy, reproduce, distribute, sell, or resell content from the Service
  • Share exam content or attempt to build competing question banks from the Service
  • Use bots, scripts, crawlers, or automated tools without permission
  • Reverse engineer, probe, scan, or interfere with the Service
  • Upload malicious code or harmful content
  • Use the Service for unlawful, fraudulent, or abusive purposes
  • Circumvent access restrictions, bans, payment controls, or security measures

We may investigate suspected violations and take appropriate action.

9. Anti-Abuse and Enforcement Policy

To protect the Service, users, and content, we reserve the right to detect, investigate, and prevent misuse.

We may use reasonable technical and operational measures to identify suspicious or abusive activity. These may include reviewing:

  • Login patterns
  • Session activity
  • Device or browser identifiers
  • IP addresses
  • Usage behavior
  • Security events

Such measures, where used, will be limited to what is reasonably necessary for security, fraud prevention, operations, and enforcement.

If we determine, in good faith and at our reasonable discretion, that misuse has occurred, we may take action including:

  • Warning the user
  • Restricting features
  • Logging out active sessions
  • Temporary suspension
  • Permanent termination
  • Blocking devices, networks, or IP addresses
  • Refusing future access

Where permitted by law, such actions may be taken without prior notice and without refund.

We are not liable for losses arising from enforcement actions taken in good faith to protect the Service.

10. Service Availability

The Service is provided on an "as is" and "as available" basis.

We do not guarantee uninterrupted, secure, timely, or error-free operation. We may modify, suspend, discontinue, or remove features at any time.

We are not responsible for outages, delays, data loss, incompatibility, third-party failures, or events beyond our reasonable control.

11. Third-Party Services

The Service may integrate with or rely on third-party tools, hosting providers, analytics providers, payment processors, or external links.

We are not responsible for third-party products, services, content, availability, or policies.

Your use of third-party services may be subject to their separate terms and privacy policies.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided without warranties of any kind, express or implied
  • We disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement
  • We are not liable for indirect, incidental, special, exemplary, punitive, or consequential damages
  • We are not liable for loss of profits, revenue, business opportunity, goodwill, data, results, or exam outcomes
  • Our total aggregate liability arising out of or related to the Service will not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim

Some jurisdictions do not allow certain limitations, so parts of this section apply only to the extent permitted by law.

13. Indemnity

You agree to defend, indemnify, and hold harmless ExamOS, its owners, operators, affiliates, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from:

  • Your misuse of the Service
  • Your violation of these Terms
  • Your infringement of any rights of another person or entity
  • Content or data you submit through the Service

14. Termination

We may suspend, restrict, or terminate your access at our discretion where reasonably necessary, including for breach of these Terms, security concerns, suspected fraud, prolonged inactivity, legal compliance, or operational reasons.

Upon termination, your right to use the Service ceases immediately. Provisions that by nature should survive termination will continue to apply.

15. Governing Law and Disputes

These Terms are governed by the laws applicable in our principal place of business, without regard to conflict of law principles.

You agree that courts located in that jurisdiction will have exclusive jurisdiction over disputes relating to the Service, except where mandatory law provides otherwise.

Before filing a formal claim, both parties agree to attempt to resolve the dispute through good-faith discussions.

16. Changes to Terms

We may update these Terms at any time by posting a revised version on the Service.

Changes become effective when posted unless otherwise stated. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
